COMMITTEE OF THE WHOLE MEETING
AUGUST 16, 2010

CALL TO ORDER
Mayor Berman called the meeting to order.

ROLL CALL
In attendance: Mayor Dale Berman, Trustee Mike Herlihy, Trustee Mark Guethle, Trustee Mark Gaffino, Trustee Vince Mancini, Village Clerk Lori Murray. Not in attendance: Trustee Chris Faber, Trustee Bob Strusz.

Staff in attendance: Atty. Kevin Drendel, Chief Administrative Officer Wes Kornowske, Finance Director Bill Hannah, Community Development Director Scott Buening, Public Works Superintendent Mike Glock, Water Superintendent Paul Young.

DISCUSSION
1. Discussion on a Special Use for used Car Sales at 10 S. Lincolnway
The Plan Commission, at their last meeting, voted 5-1 to recommend denial for the special use. The Development Committee met on the 16th and was split on whether they wanted to support the use. Staff did not feel that the conditions met the special use. Trustee Herlihy noted that this type of use was sited as an example of the factors which qualified it for a blight area of the TIF district.

David Howard, 522 N. Lake Street, Aurora, IL – Atty Howard said that the space had been vacant for a number of years and has not produced any revenue. The area was previously used as a used car lot. Howard said that the property’s best and highest use would be for a car lot. If left vacant, the property would remain that way and produce no sales tax revenue. Howard said that the business would bring in $12,000 per year in tax revenue.

Kevin McDuffee, 38W380 Lee Drive, Geneva, IL – McDuffee said that prior to the sale of the lot, the property was leased to a car lot owner. McDuffee said the Village had no problem or objections at the time. It is zoned B2.

Steve McDuffee – McDuffee said he called the city between January and April of 2008 and inquired about the zoning. He was told it was B2, which would allow for a used car lot. McDuffee said that it is now zoned B3. McDuffee said that his neighbors are not objecting to the use and didn’t understand the problem.

Ron Eggert, North Aurora, IL – Eggert said that any tax revenue would be helpful to the village and that as an unemployed villager, would be given an opportunity to have a job in this business.

Trustee Mancini said he saw a problem with egress. Mancini said he struggled with the amount of traffic that would or would not go through the property. Mancini said he did not believe the used car business would fit in with the area. Mancini asked if a traffic study was done. Answer was no.

Trustee Herlihy suggested the Board review the original TIF before making any decisions.

The Board decided to hold off further discussion until the next Committee of the Whole Meeting.

EXECUTIVE SESSION
Motion made by Trustee Herlihy and seconded by Trustee Guethle to adjourn to Executive Session for pending litigation.

ADJOURNMENT
Motion to adjourn made by Trustee Herlihy and seconded by Trustee Mancini. All in favor. Motion approved.
