VILLAGE BOARD MEETING

CALL TO ORDER
In the absence of Village President Hansen, Trustee Max Herwig called the meeting to order at 7:00 p.m.
ROLL CALL
In attendance: Trustee Max Herwig, Trustee Dale Berman, Trustee Mike Herlihy, Trustee Bob Strusz, Trustee Mark Gaffino, Trustee Linda Mitchell. Not in attendance: Village President John Hansen.
Staff in attendance: Village Administrator Sue McLaughlin, Management Analyst Wes Kornowske, Finance Director Bill Hannah, Community Development Director Scott Buening, Public Works Superintendent Mike Glock, Village Engineer Jim Bibby, Water Superintendent Paul Young, Police Chief Tom Fetzer, Fire Bureau Chief Mark Bozik.
AUDIENCE COMMENTS
1. Larry Miller, 305 Long Ave, North Aurora, IL – Mr. Long explained to the Board that his neighbor at 307 Long Ave. put in a side driveway to go to a new garage that he built in the back yard and fenced along the east-west property line. The neighbor had buried two four-inch PVC pipes that drained at the entire western edge of his house onto Mr. Miller’s lot. Mr. Miller said that he approached the Village six weeks ago and asked if this was legal. The code enforcer called and said he was not sure and would investigate further. Mr. Miller said he waited a month without an answer. Mr. Miller asked the Board if this is legal, and if it is not, why it wasn’t caught during final inspection when the garage and side driveway were built. Public Works Superintendent Mike Glock said that he heard there was a downspout running into Mr. Miller’s side yard. Glock said this issue was discussed at the Staff meeting today and research is being done to determine if this is allowed. Atty. Drendel said that there are two issues. One is whether it violates a village code. There is an issue between the two property owners and a property owner has a right not to have their neighbor’s property drain onto their own property. Village Administrator Sue McLaughlin said that Staff is working on the issue. Trustee Berman asked if the exit to the pipe was on Miller’s property. Mr. Miller said it is on the neighbor’s property, but just barely. Trustee Herwig asked that Village Administrator Sue McLaughlin or Community Development Director Scott Buening get back to Mr. Miller on this issue.
2. Mr. Miller approached the Board with another issue. Miller said that he paid a recapture fee of $4,000 when he hooked up to water and sewer last summer. Miller said he understood that that money would be distributed to the original petitioners of the system. Finance Director Bill Hannah said that this issue is on the Village’s to-do list and should be resolved within the next month or two.
TRUSTEES COMMENTS
Trustee Herlihy asked about lawn and weed control in the Village, adding that there are areas of the Village that have yet to be mowed this year. Mike Glock said that a letter went out to developers on June 1st, telling them that they had to comply with the ordinance.
Trustee Gaffino agreed with Trustee Herlihy, especially in the case of foreclosed homes. Gaffino said that there is a house on McDuffee that is in foreclosure and has a dumpster that has been on the property for two weeks.
