MAY 7, 2012

CALL TO ORDER
Mayor Berman called the meeting to order.

ROLL CALL
In attendance: Mayor Dale Berman, Trustee Chris Faber, Trustee Ryan Lambert, Trustee Mark Guethle, Trustee Mark Gaffino, Trustee Laura Curtis, Trustee Vince Mancini, Village Clerk Lori Murray

Staff in attendance: Village Administrator Wes Kornowske, Village Attorney Kevin Drendel, Finance Director Bill Hannah, Community Development Director Scott Buening, Police Chief Dave Summer, Public Works Superintendent Mike Glock, Water Superintendent Paul Young.

DISCUSSION
1. Discussion on Social Media Administrative Policy
Wes Kornowske stated that the policy deals with employee use of the social media during work hours. The police was modeled from the Village of Montgomery. Atty. Drendel said that the policy can be fairly restrictive in terms of personal use on Village time. The Village can restrict posting to only authorized personnel. The problem area is restricting what people say on their own time. Atty. Drendel said that there are first amendment issues. If someone posts something negative about the Village and it is posted as a citizen, there is a first amendment right for them to do that and they could not be punished for it. If they were speaking about a more personal issue, they could be disciplined. Trustee Mancini said that according to the Supreme Court, an employee’s speech can be disciplined if it is done during work time.

ADJOURNMENT
Motion made by Trustee Gaffino and seconded by Trustee Guethle to adjourn to executive session for the purpose of land acquisition and labor negotiations.
All in favor. Motion approved.
