VILLAGE BOARD MEETING MINUTES
APRIL 4, 2016

CALL TO ORDER
Mayor Berman called the meeting to order.

ROLL CALL
In attendance: Mayor Dale Berman, Trustee Laura Curtis, Trustee Mike Lowery, Trustee Chris Faber, Trustee Mark Carroll, Trustee Mark Gaffino, Trustee Mark Guethle, Village Clerk Lori Murray.

Staff in attendance: Village Administrator Steve Bosco, Finance Director Bill Hannah, Police Chief Dave Summer, Public Works Superintendent Mike Glock, Water Superintendent Paul Young, NAFD Captain/Fire Marshal Eric Bunkofske, Village Attorney Kevin Drendel.

PROCLAMATION
1. Arbor Day Proclamation
Mayor Berman proclaimed April 29, 2016, Arbor Day, in the Village of North Aurora.

AUDIENCE COMMENTS
Allan Broholm, 518 Bede Circle, North Aurora, IL, addressed the Village Board regarding a concern with flooding of his home. Broholm said that last June 15, his house along with five others in his subdivision flooded. The Village had commissioned an engineering study to figure out what could be done to resolve the situation in terms of the water that flows off of the Marmion property. Broholm stated that he has learned that Marmion is building additional parking for the Abbey building. A drain tile is being installed and will go to the ditch on the east side of Hart Road to the West side of Hart Road and this will result in future flooding to his home and his neighbors’ homes. The Village spoke with Marmion to possibly do something on the west side of Hart Road to alleviate the problem of water flooding North Aurora homes. Marmion has said they will not allow the Village to do anything on the west side of Hart Road. Broholm said his concern is that his house is now unsaleable due to flooding. Broholm said this has to be a cooperative effort between Marmion, North Aurora and homeowners. Broholm added that it appears the only way to force Marmion to do something might be to go to court. Atty. Drendel said he looked into the issue this afternoon, but did not have a definitive answer.

Bosco mentioned that Marmion said they would not grant the Village of North Aurora an easement on the property. Marmion said they are willing to work with the Village through their engineer at the Village’s cost.

CONSENT AGENDA
1. Approval of Village Board Minutes dated 03/21/2016 and Committee of the Whole Minutes dated 03/21/2016
2. Approval of a Resolution to Approve the Revised 3rd Amendment to an Intergovernmental Agreement Between the Village of North Aurora and the County of Kane Regarding Jurisdictional Transfer and Access to Randall Road from Orchard Road to I-88 Bridge South Abutment.
Motion for approval made by Trustee Guethle and seconded by Trustee Gaffino. Roll Call Vote: Trustee Guethle – yes, Trustee Gaffino – yes, Trustee Carroll – yes, Trustee Faber – yes, Trustee Lowery – yes, Trustee Curtis – yes. Motion approved (6-0).

NEW BUSINESS
1. Approval of Waste Hauler Contract for the Village of North Aurora’s Residential
Refuse, Recycling and Yard Waste Collection Program
Proposals for Waste Management and Advanced Disposal were fairly close in price in terms of sticker price. Toters were cheaper with Advanced Disposal. The current sticker price with Waste management is $3.61 and toters are $28.00/mo.

Trustee Curtis said she would be in favor of going with the proposal from Advanced Disposal.

Motion made by Trustee Guethle and seconded by Trustee Lowery to approve the current program proposal by Waste Management. Roll Call Vote: Trustee Guethle – yes, Trustee Gaffino – yes, Trustee Carroll – no, Trustee Faber – no, Trustee Lowery – yes, Trustee Curtis – no, Mayor Berman – yes. Motion approved (4-3).

Curtis went on record to state the Village has now increased pricing for its residents on stickers and provided no incentive for toters.

2. Approval of Legal Fees from Drendel and Janson’s Law Group for Legal Services
Motion for approval made by Trustee Guethle and seconded by Trustee Lowery. Roll Call Vote: Trustee Guethle – yes, Trustee Gaffino – yes, Trustee Carroll – yes, Trustee Faber – yes, Trustee Lowery – yes, Trustee Curtis – yes. Motion approved (6-0).

3. Approval of Renewing an Intergovernmental Agreement between the Village of
North Aurora and Kane County Animal Control for Animal Control Services
Motion for approval made by Trustee Guethle and seconded by Trustee Gaffino. Roll Call Vote: Trustee Guethle – yes, Trustee Gaffino – yes, Trustee Carroll – yes, Trustee Faber – yes, Trustee Lowery – yes, Trustee Curtis – yes. Motion approved (6-0).

4. Approval of an IDOT MFT Resolution for Streets and Highway Maintenance for
Crack Sealing/Filling
Motion for approval made by Trustee Gaffino and seconded by Trustee Guethle. Roll Call Vote: Trustee Gaffino – yes, Trustee Guethle – yes, Trustee Carroll – yes, Trustee Lowery – yes, Trustee Curtis – yes, Faber – yes. Motion approved (6-0).

5. Approval of a Pay Request No. 1, Partial, to Patnick Construction Inc. in the
Amount of $71,212.50 for the 2016 Watermain Project
Motion for approval made by Trustee Guethle and seconded by Trustee Carroll. Roll Call Vote: Trustee Guethle – yes, Trustee Gaffino – yes, Trustee Carroll – yes, Trustee Lowery – yes, Trustee Faber – yes, Trustee Curtis – yes. Motion approved (6-0).

6. Approval of a Bill List dated April 4, 2016 in the Amount of $232,277.02
Motion for approval made by Trustee Gaffino and seconded by Trustee Carroll. Roll Call Vote: Trustee Gaffino – yes, Trustee Guethle – yes, Trustee Carroll – yes, Trustee Lowery – yes, Trustee Faber – yes, Trustee Curtis – yes. Motion approved (6-0).

ADMINISTRATOR’S REPORT
Village Administrator Steve Bosco noted that the Village received a concept plan for a Shell Station/Dunkin Donuts at the old Marathon Gas Station location on Lincolnway. Bosco asked the Board if this is something the Village should entertain. The Board decided it did not want another gas station on that property.

ATTORNEY’S REPORT – None

FIRE DISTRICT REPORT
Eric Bunkofske reported that the fire department would begin its semi-annual hydrant flushing next week on Monday, April 11th. The hydrant flushing is scheduled for three weeks.

VILLAGE DEPARTMENT REPORTS
1. Finance – None
2. Community Development – None
3. Police – Chief Summer mentioned that the Police Department will be supporting Autism Awareness on April 2nd by lighting the building in blue lights.
4. Public Works – Street signs are being replaced in the Tanner Trails subdivision and the update to new street signs is now 95% complete.
5. Water – None
