PLAN COMMISSION MEETING MINUTES
FEBRUARY 3, 2015
CALL TO ORDER
Chairman Brackett called the meeting to order.
ROLL CALL
In attendance: Chairman Mike Brackett, Commissioners Mark Bozik, Connie Holbrook, Jennifer Duncan, Aaron Anderson, Anna Tuohy, Mark Rivecco, Doug Botkin. Not in attendance: Commissioner Tom Lenkart.
Staff in attendance: Community & Economic Development Director Mike Toth, Village Administrator Steve Bosco, Village Clerk Lori Murray.
APPROVAL OF MINUTES
1. Approval of Plan Commission Minutes dated January 6, 2015
Motion for approval made by Trustee Duncan and seconded by Trustee Rivecco. All in favor. Motion approved.
PUBLIC HEARING
1. The Village of North Aurora requests a text amendment to Title 17 of the North Aurora Municipal Code (Zoning Ordinance) to allow Tattoo Parlors as a permitted use in the B-2 General Business District, I-1 Limited Industrial District and I-2 General Industrial District
Items of concern from the last meeting were addressed in the municipal code. Concerns from the last meeting included loitering in front of a business, proper disposal of bio-hazard materials, parent or guardian physically accompanying anyone under the age of 18 and steeper fines for violations.
Loitering
Additional language was added to state business owners be responsible for discouraging any loitering. Loitering is very subjective so language was used from the existing code. Commissioner Botkin said he was uncomfortable calling out this particular business type and suggested eliminating the verbiage since it is already in place in the general ordinance. The Plan Commission was not opposed to this. Community & Economic Development Director Mike Toth said he would strike the proposed loitering language pertaining to tattoo parlors.
Disposal of bio-hazard material
Toth said he included wording from the Illinois Pollution Control Board Standards for Potentially Infectious Medical Waste Materials. Toth said he is authorized to inspect the premises at any given time and Kane County Health Department will also do an inspection on an annual basis.
Accompanying anyone under the age of 18
Section 5.3.610 of the staff report states that anyone who is employed may not allow anyone under 18 onto the premises. Anyone under the age of 18 has to be accompanied by an adult.
Steeper fines
The State code has fines that are in excess of $1000 per violation. The Village’s municipal fines are less than what the operator could be fined by the State. Toth said that the fines are fairly steep on both ends so did not see the need to increase it on the Village’s end.
Toth stated that the amendments were brought to the Committee of the Whole meeting and the Board was in agreement with the regulatory ordinance and zoning text amendments. The next step is to take the amendment and the regulatory ordinance to the Village Board meeting for final approval.
Commissioner Duncan suggested changing the wording in the ordinance to reflect maintaining client information on a “computer list” instead of as it currently reads, “index card” for three years. Duncan also noted that she was concerned with privacy issues with having to keep a record of every single person and a picture of their tattoo. Toth said he will look at State requirements and discuss the issue with the Village Attorney.
Motion made by Commissioner Aaron and seconded by Commissioner Holbrook to go with Staff’s recommendations for the tattoo parlor text amendments.

OLD BUSINESS
1. Comprehensive Plan Update
Toth said that the Village has reviewed the existing conditions report with the consultants. Will schedule another Steering Committee meeting in the next couple of weeks. At that point, the Comprehensive Plan will be complete.
PLAN COMMISSIONER COMMENTS AND PROJECT UPDATES
-Bull Dog Ale House received their liquor license at a previous Village Board meeting and it goes into effect on March 1, 2015. Toth said they are working on the interior buildout at this time.
-The owner of the Turf Room will be opening a brew pub on the northeastern most property of Oak & Orchard.
-Commissioner Tuohy asked if there has been any discussion about traffic control in that area, specifically where Tanner Road runs into Deerpath Road. Toth said that there will be realignment to Deerpath and there may be additional traffic controls installed.
