PLAN COMMISSION MEETING MINUTES
NOVEMBER 3, 2015

CALL TO ORDER
Chairman Brackett called the meeting to order.

ROLL CALL
In attendance: Chairman Mike Brackett, Co-chairman Jennifer Duncan, Commissioners Aaron Anderson, Mark Rivecco, Anna Touhy, Mark Bozik, Doug Botkin. Not in attendance: Commissioners Connie Holbrook and Tom Lenkart.

Staff in attendance: Village Administrator Steve Bosco, Community & Economic Development Director Mike Toth, Village Clerk Lori Murray.

APPROVAL OF MINUTES
1. Approval of Plan Commission Minutes dated October 6, 2015
Chairman Brackett noted a change to last month’s Plan Commission Minutes. Brackett stated that he had voted yes for petition 15-06. Motion for approval made by Commissioner Duncan and seconded by Commissioner Tuohy to approve the minutes with the change noted by Chairman Brackett. All in favor. Motion approved.

PUBLIC HEARING
1. Petition #15-05: The Village of North Aurora requests a Zoning Ordinance text amendment to reclassify certain uses in the B-1 Community Business District, B-2 General Business District and B-3 Central Business District.
Chairman Brackett opened the public hearing.

Mike Toth mentioned that massage parlors would be considered a special use and that use standards would be created.

Commissioner Touhy asked how psychic and fortune telling businesses would be regulated as an in-home business. It is currently listed as “not pertinent”. Toth said this type of business is allowed as a special use in the I-2 district. Toth added that the business could be in a home, but the business could not have any signage and there would be separate regulations associated with the business.

Commissioner Bozik questioned if making massage parlors a special use is the best way to control the business rather than through licensing. Toth said that the Village can put a business operator on notice for a special use and have it revoked per a board hearing. Bozik said he would like to have a standardized document to note specific standards for each massage parlor and enforce it across the board. Toth said that use standards could be created which would be above and beyond the standards for special uses.

Touhy asked about the difference between a salon and a spa. Toth said he would look at the floorplan of a business in determining between a salon and a spa. He noted that some salons also have massage services available. If there are salon chairs with mirrors and wash sinks for shampooing and the massage area is less than 25% of the area of the floorplan it would be a salon.

Touhy questioned feed store being listed as not pertinent to North Aurora. Toth said if someone is selling products indoors, it would be a permitted use. If there is any outdoor component, it would be a special use.

Co-chairman Duncan asked about residential hotel/motel and it being noted that long term is not desirable. Duncan said there is a lot of talk about Airbnb where people will rent a bedroom of their house or their entire house. Toth said those are short term rentals. Bosco noted that the discussion is currently about the business district right now. Rivecco mentioned that bed and breakfasts are listed as a special use in the B-1 and B-3 districts.

There was no further discussion and Chairman Brackett closed the public hearing.

NEW BUSINESS
1. Petition #15-05: The Village of North Aurora requests a Zoning Ordinance text amendment to reclassify certain uses in the B-1 Community Business District, B-2 General Business District and B-3 Central Business District.
Motion made by Commissioner Rivecco and seconded by Commissioner Bozik to approve petition #15-05 with staff’s recommendations and include massage establishments as a special use in the B-2 and B-3 districts. Roll Call Vote: Rivecco – yes, Tuohy – yes, Anderson – yes, Duncan – yes, Bozik – yes, Botkin – yes. Motion approved (6-0).

OLD BUSINESS – None

PLAN COMMISSIONER COMMENTS AND PROJECT UPDATES
Community & Economic Development Director Mike Toth reported on the following updates:

-A medical cannabis facility will open in November at 161 S. Lincolnway.

-A traffic study is being done for stop signs on Deerpath Road.

-The Village Board will vote on the 28-acre project on Orchard and Oak on November 16th.

-Medical/dental office looking to go into the Randall Highlands as a stand-alone building.

-BBQ/fireplace store going into Orchard Crossing.

Toth said he has heard back from Continental Properties and they are getting positive feedback from retailers for the commercial portion of their property.

Village Administrator Steve Bosco said that Staff will be going to the Village Board with a text amendment for the boundary line agreement with Aurora. There will be no change to the agreement, only an amendment as to how the Village makes its connections to the city.

Motion to adjourn made by Commissioner Duncan and seconded by Commissioner Rivecco. All in favor. Motion approved.
